They are soon overwhelmed by the task, feeling discouraged and guilty. Vegetable gardening should be fun. If it becomes an onerous chore to water, weed, thin and pick, you will probably give up. We all live busy lives. When you start grumbling about going out to the garden after a days work, the garden is going to suffer. Getting Started * Start small, gain confidence. A single raised bed 2m (6ft) by 3m (9ft) or 4m (12ft) is large enough. You can always add beds later as your confidence and skill grows. If you already have a large bed to begin with, consider dividing it up into smaller sections. Maybe plant some flowers or herbs to fill in the area? If your area is large, another idea is to plant squash or pumpkins they cover a large area and help to reduce maintenance. * Choose a site that gets at least 6 hrs of sunlight per day * Remove the sod from the site, shake off the soil and add the sod to your compost bin. It speeds up the composting if you rip up the sod into small pieces. If you don’t have a compost bin, build one. You will be doing your garden a favour in the future. If there is …

Jim contracted with Kevin to serve as a guide for Kevin on his three-week fishing trip to Canada. The contract was made on April 1 with the trip to begin on June 1. On May 1, Kevin notified Jim that he had changed his mind and would be unable to make the trip. He also refused to pay Jim any compensation.
a. Because the contract is executory, Jim has suffered no damages, and Kevin has no obligation to pay any compensation.
b. Kevin has anticipatorily repudiated the contract and is liable to Jim for damages.
c. If Kevin changes his mind again and decides to go on the trip, Jim will have to perform unless he has notified Kevin that he is canceling the contract.
d. Both (b) and (c) above are correct.

Mount Norquay, Sunshine Village and Lake Louise make up the three ski areas of Banff. All three resorts are unique in their own way with Mount Norquay being the closest to town, a quick 15 minute drive from downtown.

Mount Norquay is particularly popular with ski racers and locals who like steep fall line skiing; this is what the resort is really all about. Although the ski area is relatively quiet with a spacious and charming lodge, the skiing is not really suited to beginner and novice skiers. Unless you are a competent parallel skier, the trails at Norquay will seem daunting. My advice as a former ski instructor in the area would be to recommend this resort to “seasoned’ skiers” who like the challenge of steeps, bumps and hard pack conditions.

Sunshine Village is the next resort closest to town and can be found by driving West on Highway 1 towards Lake Louise. The drive takes approximately 30 minutes but can take longer on stormy days. Once you arrive at the car park you must ride the gondola to reach the ski area. This takes about twenty two minutes normally. Sometimes on very cold days (Often in December and January) the gondola will not run first thing probably for safety reasons. There are also occasions when windy conditions affect the time duration of the gondola ride.

he skiing conditions at Sunshine Village are generally excellent from early December (and often earlier) until late May. This is primarily due to its location and relatively high altitude which is comparable to high elevation European resorts.

Most British tourists who visit Sunshine Village fall in love with the scenery, light snow and skiing. The resort is of average size (compared to European and US resorts) and the trails are suitable for all levels except experts. If you are a “die hard” skier who has skied some of the serious resorts of the world you may find Sunshine unimpressive. This is because the trails are relatively short and not particularly steep. Delirium Dive is the one exception but this area is often closed for much of the season for safety reasons.

If you are a beginner skier you may find the learning area small and often crowded on weekends and holidays. However once you graduate away from this area you will find many enjoyable “green trails” to keep you happy.

For Intermediate skiers who make parallel turns or semi parallel turns Sunshine Village is a perfect place to ski. The vast majority of trails here are ideally suited for this level of skier who will love the wide open slopes and great conditions.

Sunshine Village is a truly beautiful resort to see and ski at. Most people who come here have a positive skiing experience and except for the cold weather (December and January particularly) it is hard to fault Sunshine.

The last area that makes up the ski areas of Banff is Lake Louise. Lake Louise is particularly good for intermediate to advanced skiers. Although the ski area is relatively big most of the trails are not particularly suited for beginner and novice skiers. The initial learning area however is very good (with the exception of the T-bar lift which most beginners and novices dislike). However once this area is mastered (usually between one and three days) the next step is relatively large.

Although there are many “green trails” on the front side and backside of the mountain, most of them are not particularly easy. What compounds this problem is that the front side is often hard packed and scraped due to the artificial snow that is made here. The backside does not suffer with this problem however the only trail down the mountain is a narrow path which is often intimidating for novice skiers.

For most intermediate skier’s Lake Louise is normally a wonderful experience with an abundance of long trails. In my opinion the better skiing is to be found on the backside particularly the Larch Area. Advanced skiers will also love the backside particularly on a “powder day”.

To sum up my analysis of the three areas and where one should ski when visiting Banff this is my recommendation.

Mount Norquay

Mount Norquay is ideally suited to competent parallel skiers and not beginner or novices.

Lake Louise

If you are a first time skier Lake Louise has the best learning area of all three mountains. Except for the T-bar lift, most beginner and early novice skiers make good progress here. Lake Louise is not so good for the same skiers after two days of learning as the next step up the mountain is quite challenging for most. Many of the Lake Louise “green trails” are steep, narrow or hard pack. The front side of the mountain (especially lower down nearer the bottom) is often icy and hard packed due to man made snow. The backside of the mountain is usually much better for most levels of skier.

Sunshine Village

Sunshine Village is ideal for most skiers except experts. The resort has a small beginner area that gets busy on weekends and holidays. The scenery and snow at Sunshine Village are breathtaking and except for the early season (December and January when it can be very cold) Sunshine skiing is hard to fault.

If you are a competent parallel skier I would suggest you try all three resorts and decide for yourself which is your favourite. Happy skiing this winter.

While the public transportation systems in many international destinations are safe, clean, cheap and reliable, many seasoned travelers prefer having their own transportation, and in many areas it is necessary to rent a car to get from place to place.

There are a number of thing to remember to make renting a car internationally less costly and less of a hassle.

One of the most important things to remember involves traveling to Canada and Mexico in an American based rental car. In most cases, the insurance that comes with the rental car does not cover you once the car has left the country.

If you are not sure about your coverage, always be sure to check your rental agreement. While this is important in Canada, it is vital in Mexico.

While it is possible to buy special Mexican car insurance when traveling there, it is generally not recommended that casual visitors drive into Mexico. It is generally better to park in one of the border lots and take the shuttle bus to the border.

If you plan to drive abroad, either in Canada, Mexico, Europe or anywhere else outside the United States, it is a good idea to obtain an international drivers permit.

While an international drivers permit is not required everywhere, it is a good idea to get one. The fee to obtain an international drivers permit is low, and the literature that comes along with it is quite valuable. An international drivers permit can be obtained through an AAA office.

It is also important to check with the company that provides your auto insurance to see if you are covered for international driving. If your normal policy does not cover you, inquire about purchasing a special policy for your trip. Also check with your credit card company to see if the rental car collision coverage they offer is good outside the country.

When arranging for a rental car, it is usually less costly to do so before you leave the United States. It can also be considerably more trouble to wait until you arrive to rent a car, and you always run the risk that the type of car you want is not available.

When renting cars in Europe, it is generally best to choose a compact or subcompact car, as many of the streets in European cities are quite narrow, and parking is often very limited. It is best to rent the smallest car you feel comfortable with.

If you plan to combine a car rental with a rail pass, there may be discounts available. Always be sure to check with your travel agent and take advantage of any discounts to which you are entitled. Some hotels and airlines also have special deals on rental cars for their customers.

If you will be dropping off your rental car in a different location that where you picked it up, which is common in European rentals, be sure to choose a rental agency that offers a low drop off fee.

When planning your trip, always keep in mind that prices for gas and diesel fuel are generally much higher than those in the United States, often as much as three times as expensive. Be sure to factor fuel costs into your travel budget. This is yet another reason to rent the smallest car you can find.

Another reason a small car is important is the frequent lack of available parking in many resort areas and near many major tourist attractions. Even if you have a car, you may want to leave it at the hotel and take public transportation to these types of destinations.

When you pick up your car, be sure that you get the terms you agreed to before you left home. If the terms are not agreeable when you get there, be prepared to cancel the deal and make alternate arrangements.

It is also important to take a company representative with you and carefully examine the car’s exterior for dings and scratches. Be sure to note any pre existing damage to avoid being charged for it when the car is returned.

In the 21st century, the property market in Canada — the Great White North — is dominated by people looking to purchase vacation properties and by investors looking to capitalize on the growth that is being experienced in some of the larger cities within the country. What is important to keep in mind is that the vast majority of the citizens of Canada actually live within one hundred miles of the Canadian and U.S. border. As a result, the hot markets for property — with the exception of some holiday and vacation properties located further north — tend to be along the one hundred mile band near the Canadian and U.S. borderline.

With all of this noted, there are some different opportunities available to a foreign national who is interested in making an investment in Canadian property — either for personal, commercial or investment purposes.

Investment Property in Canada

As mentioned previously, the vast majority of the population of the nation of Canada is situated in a one hundred mile radius from the Canadian and U.S. border. Therefore, when it comes to real property investing, the marketplaces that a foreign national should serious consider is that band of property that lies in those cities and communities within that hundred mile band. By far, this represents the area in which the greatest amount of growth in both the real estate market and the development of other commercial enterprises is being seen in the 21st century.

Commercial properties remain a decent investment when it comes to real estate in Canada. As of yet, most of the major Canadian cities have not been overdeveloped. There remains a decent demand for commercial building space in most of the major Canadian points of commerce. As a result, a foreign national interested in investing in commercial property does have room to maneuver in this day and age.

People with a more limited amount of money to invest might want to consider investing in residential property that can be leased to travelers on holiday or vacation. Tourism remains a strong industry in Canada. As a result, there remains money to be made through the ownership of residential property that can be made available to tourists within the country.

Residential Property in Canada

Like its neighbor to the south, the Canadian residential real estate market significantly varies depending on which community is being considered. Not surprisingly, the costs associated with single family homes continues to rise in the larger and more major Canadian cities. At the present time, the more rural and outlying residential housing market in the country is a bit flat. In other words, if you are looking for bargains on residential property, a foreign national might want to consider one of the more rural or northward lying communities when looking to purchase such property.

Keeping in mind that a goodly share of the foreign nationals who are shopping for and purchasing residential property in Canada are doing so to set up a holiday retreat. Therefore, a more rural setting oftentimes is a welcome choice for such a property investor.

Residential Real Estate – Apartments in Canada

There is something of a boom when it comes to the residential property market as far as apartment units are concerned. With some growth being experienced in some of the more major Canadian cities, the demand for apartments and similar types of multi-family housing units is increasing.

Many foreign nationals who have a desire to experience Canadian life for holiday purposes are snatching up apartment units in different cities in the country. More often than not, these foreigners are making the purchases of such properties in the larger cities at the southern end of the country.

In some more rural areas, the number of apartment units also has been increasing in recent years. Some foreign nationals have taken to investing in these types of operations for investment purposes and have taken to buying shares in apartment complex enterprises.

Holiday Property in Canadian Holiday Resorts

As referenced previously, tourism and travel remains a top industry in Canada. Indeed, each and every year, an ever growing number of men and women are flocking to the Great White North for holiday or vacation purposes. Consequently, the demand for holiday real property has increased significantly, particularly over the course of the past twenty to twenty five years.

Quite like in the United States, investment in holiday property in Canada is taking two different forms. First of all, people — both Canadians and foreign nationals — are buying holiday property for their own, personal use. In addition (and as has been mentioned previously) a growing number of people are buying vacation properties to be utilized for more of an investment purpose. Foreign nationals, for example, can be found buying holiday property which they then in turn lease or rent to other individuals who happen to be on vacation of holiday. For some investors, this has proven to be a very lucrative avenue of real estate ownership.

Specific Steps to Buying a Property in Canada

In Canada, all matters pertaining to the buying and the selling of property is subject to governmental regulation. Once the parties to a potential sale of property have agreed on a price (after negotiating between themselves), a preliminary contract is entered into between the parties. This preliminary contract is known either as an Offer to Purchase or as an Agreement of Purchase and Sale. At the time the preliminary agreement is entered into between the parties, a deposit is made by the buyer.

The preliminary agreement can take one of two forms. On the one hand, the preliminary agreement can be conditional. By conditional, it is meant that certain events need to occur or certain milestones accomplished before a contract can become firm. An example of such a conditional provision would be one to obtain financing. If the condition or conditions within the agreement cannot be satisfied for some reason, the seller will receive most of his or her deposit back.

A firm preliminary contract is one in which there are no conditional provisions. If a firm preliminary agreement is not fulfilled, financial penalties can be imposed. For example, if the seller does not perform under the contract, he or she will lose the deposit paid. Likewise, some sort of financial penalty will be imposed on the seller if he or she does not perform under the terms of the firm preliminary agreement.

Within the provisions of the preliminary agreement will be established a completion date. The completion date is when all of the conditions in the preliminary agreement need to met. It is at this point that the remainder of the purchase price will be paid by the buyer to the seller. (Obviously, the buyer will need to have his or her financing in place by this point in time.) It is at this juncture that the transfer of ownership of the property from the buyer to the seller will occur.

The money associated with the sale is paid whether through a solicitor or a notary. At this juncture, the buyer and the seller will sign what is known as a Definitive Contract. In the French-speaking province of Quebec, this is called Acte de Vente. In Quebec, the final part of the sale is overseen by a notary (or notaire in Quebec) who is a governmental official. In other provinces within Canada, a solicitor can oversee and handle the final steps of the real estate sales transaction.

In that most people will require financing to purchase property in Canada, it is important to generally understand the lending process in that country. For the most part, mortgages in Canada are so-called full status arrangements. Full status means that the lender will make a thorough and complete investigation of a borrower’s background and credit history.

In Canada, a purchaser of real estate will have to pay about 35% of the total purchase price out of his or her pocket. In many instances, this will be the size of the deposit associated with the preliminary contract to purchase property. The mortgage itself, in most cases, will be for a term of 25 years with the final payment needing to be made before the borrower reaches the age of 70.

Lenders in Canada pay very close attention to a borrower’s available income. Indeed, in most instances, a lender will closely analyze what a borrower will be expected to earn over the lifetime of the loan.

The mortgage loan itself will be secured by the property that is being purchased within Canada. Oftentimes a foreign national will seek to have property in another country utilized to at least partial zed collateralize a loan in another country. In Canada, this is not an accepted practice.

By understanding the ins and outs of the real estate purchase transaction in Canada, an investor will be in a far better position to make appropriate decisions pertaining to the buying and selling of property in that country.

Property Abroad always recommends using a Solicitor or Lawyer.
